A three-member bench comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Tariq Parvez and Justice Ghulam Rabbani passed directive on a suo motu case regarding implementation of its orders on NRO.
The bench in its order said that sufficient time had been given to the ministry but no fresh summary was submitted with the prime minister as directed by a five-member larger bench on June 11 and July 5.
At the outset of proceedings, the bench had directed secretary law Masood Chishti to appear and apprise it over the matter.
The chief justice questioned him as to why he had not prepared and submitted a fresh summary to the prime minister!
He told him that he wanted the unpleasant things to happen.
The judgement of this Court must prevail and it should be implemented, he added.
He told secretary law that his position like attorney general was different as they have to assist the Court.
"Look, your honour is attached with this Court. If you assist it properly, its honour would be enhanced," he added.
The chief justice also called upon Attorney General for Pakistan Molvi Anwarul Haq to play his role and bring the matter into notice of the prime minister.
He said "Kindly implement the judgement. It does not look good that we keep repeating such things. Good sense must always prevail."
Attorney General said that the reason might be that he had moved a plea before the larger bench for suspension of operation of implementation orders till a final decision on NRO review plea being heard by a 17-member bench.
The chief justice told him that no stay was granted over his plea so its verdict should be implemented.
Justice Tariq Parvez remarked that law ministry had violated Court's orders for not submitting a summary with the prime minister.
A five-member larger bench headed by Justice Nasir ul Mulk in July had directed the secretary law ministry to submit fresh summary with the PM.
The same bench had rejected a concise statement submitted by the Law Ministry and stated that in its summary it had made proposals to the prime minister on non-implementation instead implementation.
It had ordered that the same summary would be ignored and a fresh summary should be sent by the secretary Law or whoever may be officiating as secretary regarding its NRO orders.
