ISLAMABAD: Chief Justice Iftikhar Muhammad Chaudhry has questioned how a local government is formed when the constitution contains no definition of it, Geo News reported on Wednesday.
Three-member SC bench headed by Chief Justice Iftikhar Chauhhary was the hearing petition that challenges Sindh Local Government Act here today.
On this the petitioner Barrister Zameer Ghumro said that the local government is formed under provincial laws.
The chief justice observed that under Article 148 of Sindh Local Government Act, only responsibilities could be transferred at lower levels but not the powers.
To this, Ghumro said that Article 138 allows government to transfer powers to district officers.
In reply, CJ remarked that it means one provision allows powers while other restricts it!
