ISLAMABAD: The high profile Advocate Naimat Ali Randhawa’s murder case is facing tough tests and is feared to have nearly been spoiled to the advantage of the accused Kazim Abbas and others.
Sources reveal that not only the concerned Magistrate has declared the recently held identification parade as failed but the medico legal report is also faulty showing the bullet hitting the deceased from the right side instead of the left side.
The eyewitness, who only few days back had identified the accused Kazim Abbas, has filed an affidavit that he was wrongly attributed by the Magistrate to have told the court during the identification parade that the accused was shown to him in the police station before the identification parade. The concerned Magistrate, however, had given a certificate that the eyewitness was quoted correctly.
Further making things difficult for the police and prosecution, the sources said that the son of the deceased advocate is not yet ready to appear before the court as a witness as he was accompanying his father when he was murdered. The son was also injured in the same attack.
Just last Saturday, the eyewitness in the Randhawa murder case was reported by the media to have identified the alleged killer Kazim Abbas Rizvi during an identification parade at the judicial magistrate’s court.
But later the law enforcing agencies got the written order from the Magistrate communicating that in the open court the witnesses while identifying the accused had said that the alleged killer was previously shown to him by the police officers at North Nazimabad Police Station.
Challenging this order of the Magistrate, the eyewitness gave an affidavit stating that he had never ever told the court that he was shown the accused in the police station before the identification parade. He added that the Magistrate had also mistakenly written the wrong FIR No.
The Magistrate, however, in his certificate stated that the identification parade of the accused was held before him in the presence of court clerks and the witness.
He said that the witness rightly identified the accused and also stated that the accused was shown to him earlier in the Nazimabad Police Station. Therefore, the identification parade is hereby failed as witness has seen the accused prior to the identification parade.
On this matter, the law enforcing authorities have already approached the SHC Chief Justice. Now the authorities are preparing to go for afresh identification parade but it is feared that the case has been seriously damaged.
Meanwhile, it is also learnt that the body of the deceased Randhawa, who was allegedly killed for giving his consent to become the counsel in the murder case of Geo News reporter Wali Khan Babar, would be exhumed as the medico legal case prepared is faulty as it mentioned that the deceased was shot on his right side whereas in actual he received bullets on his left side of the body.The sources said that the spoiling of the Randhawa case would also dent the Wali Khan Babar case.
