ISLAMABAD: Former president General (retired) Pervez Musharraf, while challenging his treason trial by a special court, took the stance that since he had taken his November 3 action as Army chief, his trial could only be conducted under Army Act, Geo News reported.
Senior Advocate Khalid Ranjha filed the petition on behalf of his client Pervez Musharraf in the Islamabad High Court (IHC) today (Saturday). The special court and the interior and defence secretaries have been made respondents in the petition.
The petitioner has made a plea that the November 3 action of the declaration of emergency was taken after consultations with the relevant persons, it was not an individual action and Musharraf alone without the associates could not put on trial, as such action would be a negation of the principle of human rights and justice.
It was also stated in the petition that the November 3 action was taken as Army chief and, therefore, the trial could be only conducted under Army Act---the government decision of proceeding against him under Article 6 was malafide.
